Serving the notice

The best way to serve a notice is to personally give the tenant a copy of the notice and get them to sign a copy confirming that they have received it. Many landlords do this at the start of the tenancy at the same time that the AST agreement is signed.

Obtaining a signature from tenant confirming receipt of a section 21 notice at a later date may not be so easy if the tenant does not wish to leave.

A notice can be hand delivered to the tenants letter box. If serving notices in this way it is advisable to have a witness who can confirm that the notice was served in this way.

A notice can also be sent via first class post. If serving a notice in this way then 3 postal days should be allowed for the time taken to deliver the post and proof of postage should be obtained from the post office as proof of how the notice was served.
