Completing a Section 21 notice

A section 21 notice requires full details of the landlord, the tenants and the address of the property being rented to be completed.

If there are multiple tenants then it is advisable to serve each of them with a separate notice.

The date the notice is served is required.

The date that the notice expires is also required. This should be the last date of the tenancy which is the day before the rent is next due. However possession can only be sought AFTER that date

Thus as an example, for a 6 month tenancy starting on 10th January 2009, in order to get the tenant to leave at the end of the 6 month term, the notice must be served no later than 10th May 2009 and the expiry date should be completed as 9th July 2009.

After the notice has expired then the landlord can proceed to requesting a possession hearing in order to gain a possession order against the tenant if the tenant remains in the property.

Errors in the completion of a section 21 notice can lead to the whole possession process having to be restarted at a later date.
